1. Agreement to Terms
By downloading, accessing, or using Hex MIDI (available via Web, iOS, and Android), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to all terms and conditions stated herein, you must refrain from using the software and website.
2. Description of the Service
Hex MIDI is a professional virtual isomorphic keyboard and MIDI controller system. The application features:
- Isomorphic geometric layouts (including Wicki-Hayden, Janko, Chromatic Accordion, Park, and custom hexagonal grids).
- Built-in soundfont synthesis powered by the SpessaSynth audio engine with SF2 and SF3 format support.
- Comprehensive MIDI Input/Output routing over USB-MIDI, Web MIDI, and Bluetooth LE MIDI, with MPE (MIDI Polyphonic Expression) continuous pitch-bend support.
- Interactive timeline minimap with multi-track pattern sequencing, quantisation, and MIDI export.
- Advanced microtonal tuning engine supporting Scala (.scl) scale definitions and keyboard mapping (.kbm) files.
3. Musical Content & Intellectual Property
Your Music and Creations: You retain 100% full copyright, intellectual property ownership, and commercial exploitation rights to all musical compositions, sound recordings, MIDI files, pattern sequences, and audio tracks you create using Hex MIDI. We claim no ownership, license fees, or royalties over your performances or exported files.
Application Software and Algorithmic Geometry: The Hex MIDI software, its underlying mathematical layout algorithms (including the Axiomatic Engine), user interface designs, logos, visual tokens, and proprietary code are the exclusive property of Zung Hoang and are protected under international copyright, trademark, and trade secret laws.
4. Hex MIDI Pro & In-App Purchases
Hex MIDI offers an optional premium tier ("Hex MIDI Pro") that provides enhanced capabilities for musicians, educators, and power users:
- Pro Feature Access: Pro unlocks custom layout generation, Scala (.scl/.kbm) microtonal scale import, soundfont bank customization, extended pattern editor bars, and a 100% ad-free environment.
- Platform Payment Processing: All in-app purchases and subscriptions are processed directly and securely through the Apple App Store (iOS) or Google Play Store (Android). We do not collect, view, or store your credit card or financial billing details.
- Refunds & Subscriptions: Subscriptions renew automatically unless cancelled at least 24 hours prior to the end of the current billing cycle. All refund requests are governed by the respective store's refund policies (Apple App Store or Google Play Store).
- Purchase Restoration: You may restore your previously purchased Pro license on any compatible device using the same Apple ID or Google account via the "Restore Purchases" button in the Settings menu.
5. Advertising & Free Tier Experience
To provide free access to core isomorphic keyboard features, Hex MIDI displays advertising on supported platforms (Google AdSense on Web and Google AdMob on mobile devices):
- Shared Cooldown Controller: Full-screen interstitial ads are strictly restricted to natural milestone breaks (such as completing and saving a recording take, exporting a MIDI file, or importing a layout preset).
- No Mid-Performance Interruptions: The app enforces an initial launch grace period (no ads for the first 2 minutes) and a minimum 4-minute global cooldown between ads to safeguard your playing flow. Ads are never triggered while active notes are held.
- Ad-Free Option: Upgrading to Hex MIDI Pro permanently removes all advertising requests and banners across the app.
6. Third-Party Soundfonts, Scala Files, and Hardware
Hex MIDI allows users to import third-party soundfont archives (.sf2, .sf3) and tuning files (.scl, .kbm) from local device storage or web repositories. You are solely responsible for ensuring that you possess the necessary licenses, permissions, or public domain rights to use any third-party sound libraries or tuning tables you load into the software.
7. Acceptable Use Policy
You agree not to:
- Decompile, reverse engineer, disassemble, or attempt to derive the source code of the compiled application, except to the extent permitted by mandatory statutory law.
- Distribute, resell, sublicense, or rent the Hex MIDI application or unauthorized modified distributions to third parties.
- Interfere with, tamper with, or circumvent application licensing, Pro status checks, or advertising controls.
- Use the application to distribute malicious payloads, corrupted MIDI byte streams, or compromise connected hardware devices.
8. Offline Storage & Local Data Policy
Hex MIDI operates on an offline-first architecture. Your recorded MIDI files, custom presets, imported soundfonts, and application configurations are saved strictly to your device's local storage (such as IndexedDB on the web, and sandbox document directories on iOS and Android). We do not host your musical files on external servers. You are encouraged to regularly back up your exported MIDI files to prevent data loss resulting from device replacement or operating system resets.
9. Disclaimer of Warranties
Hex MIDI is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, low-latency performance, or uninterrupted operation. While we strive to achieve sub-millisecond responsiveness, actual audio latency depends on device hardware, operating system audio stacks, buffer sizes, and connected peripheral drivers.
10. Limitation of Liability
To the fullest extent permitted by applicable law, neither Zung Hoang, Hex MIDI, nor its contributors shall be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including loss of profits, lost recordings, corrupted data, or equipment malfunction) arising from the use or inability to use the application or website.
11. Modifications to the Service and Terms
We reserve the right to update, modify, or discontinue any feature of Hex MIDI or revise these Terms of Service at any time. When material updates are made, we will adjust the "Last updated" date at the top of this document. Continued use of Hex MIDI after revisions are posted constitutes your explicit acceptance of the updated terms.
